Why Earthbound May Never Come To Virtual Console

Way the hell back in May 2008, the ESRB rated the SNES RPG Earthbound for Wii. Nine months later, the game still hasn't arrived on Virtual Console. What's the hold-up, Nintendo?

One possible snag is legal issues stemming from the game's soundtrack. EarthBound Central notes that numerous songs on the game's soundtrack are inspired by real-life songs. For example, the Sky Runner theme sounds like the beginning of a song from The Who and the character creation screen's song samples the Monty Python theme song.

The theory is that Nintendo is holding back Earthbound for VC because they believe they'll get sodomized (legally) because of these musical similarities. Seems plausible. They could just take the music out to solve the issue but honestly, the soundtrack was one of the high points of the game.
