Warner Bros. Interactive Entertainment has inked a long-term agreement with Epic Games for Unreal Engine 3. Every development team developing a WB-published game will have access to UE3 development software.

Rocksteady Studios is currently using UE3 to make Batman: Arkham City while NetherRealm Studios is relying on the engine for their Mortal Kombat reboot. Under the agreement, these two studios will exclusively use this engine for future products. For the forseeable future, I'd imagine both studios will be focused solely on those franchises so sticking to the same engine probably won't be a hindrance.

The agreement between WB and Epic will run until 2014. It extends to any games produced for PC, console, and mobile platforms.
