Kristin Cavallari's Divorce Allegations Against Jay Cutler Have Been Revealed

Reality TV star Kristin Cavallari is experiencing a rather unfortunate slice of reality this week, as the Very Cavallari lead went public with her impending divorce from husband Jay Cutler. The split was announced on Sunday without very many details attached, but to be expected, the inherent drama soon started leaking out to fans' eyes and ears, giving everyone a better since of how the divorce proceedings will go.

While the couple's break-up is reportedly an amicable one, Kristin Cavallari and Jay Cutler reportedly indeed do have a central dispute at the heart of the divorce filings. Both parties cited "irreconcilable differences" as grounds for the divorce, but Cavallari is the only one who specifically noted "Inappropriate marital conduct" on her end. Rumors abound that this had something to do with Jay Cutler allegedly being involved with another woman, but that doesn't appear to be the case at all.

According to TMZ, the two are at odds about handling the custody of their children, which is said to be the most important element in all this for both. Kristin Cavallari was reportedly taken aback by Jay Cutler initially filing for divorce, which she didn't know was happening. (Interestingly, People notes that she noted their separation date as April 7, while Cutler marked it as April 21.) But the part that allegedly set Cavallari off was that Cutler claimed to be the "at-home parent" who served as their three kids' primary caretaker.

To the contrary, Cavallari claims that she has been their primary residential parent to their two sons and one daughter. The E! star's negative reaction seemingly showed in her own divorce paperwork, which claimed Cutler was "guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper," without explaining anything beyond that. As well, while Cutler sought joint custody of the children in his filing, the former Hills star asked specifically for primary physical custody, only granting Jay visitation.

Tennessee is known as a fault state, where fault must be proven on the part of a spouse in divorce cases, so Kristin Cavallari reportedly added the boilerplate misconduct claim as a necessary means. The actual nitty gritty of the claim falls on the shoulders of each legal team to prove. Because the custody angle has potentially become a hot button issue between the former couple, it's possible Cavallari's team will push harder to pain a negative light around Jay Cutler.

According to Entertainment Tonight, Jay Cutler was upset by Kristin Cavallari trying to get primary physical custody of their children instead of sharing equal time with him. It was also reported that Cavallari was floating the idea of moving back to L.A. and away from the Nashville home where Very Cavallari has filmed for three seasons and a holiday special. That potential eventuality is also said to be a big concern of Cutler's.

We have nothing but love and respect for one another and are deeply grateful for the years shared, memories made, and the children we are so proud of. This is just the situation of two people growing apart. We ask everyone to respect our privacy as we navigate this difficult time within our family.

It remains to be seen whether or not some of those sentiments have already soured, but fans of Kristin Cavallari and Jay Cutler may very well witness more drama in the future as the divorce proceedings gear up. And perhaps we'll see more social media users clamoring for Cutler to be the next star of The Bachelor.
